Does New Jersey allow no-fault divorce filing?

Yes – there is no reason to allege wrongdoing by either party to obtain a divorce. You can file for a no-fault divorce based on the fact that you and your spouse have developed irreconcilable differences that have persisted for six months or longer.

You may also file for divorce based on the grounds that you and your spouse have been informally separated for at least 18 months.

What are the requirements for filing for divorce in New Jersey?

Generally, you need to be a resident of New Jersey for at least a year prior to filing for divorce, although that requirement can be waived if you are seeking a divorce on the grounds of adultery.

New Jersey also allows the residency requirement to be waived for military members and their civilian spouses living when they are stationed within the state, even if they have legal residency in another state.

How long does it take to get a divorce in New Jersey?

Unlike many other states, there’s no standard waiting period before you can proceed with a divorce. If you file for divorce based on irreconcilable differences and you and your spouse agree on all the issues that must be settled, you could get through the process within a few months.

If there are issues that still need to be settled, such as the division of property and debts or matters of custody and support, a lot depends on how willing you and your spouse are to work together and compromise. If the case has to be litigated, a divorce can take well over a year.
